In this research, Professor Jürgen Simon and Christian Ravenstein have highlighted the general existing prohibition, in the labour field, of the undertaking of genetic tests that could mean discrimination for the genetic heritage of the worker. They have made a comparative study of several member States of the EU that have specific regulation on this area.     

Flourishing retail in the post-soviet sphere? Potentials and constraints of small-scale retail activities in rural Kyrgyzstan

The demise of the USSR led to the collapse of its centrally organised retail system. With this collapse the supply of consumer goods dried up, especially in the remote parts of the former USSR. At the same time the advent of capitalism offered a new institutional framework for independent retail activities. In the Kyrgyz Republic, where the economic liberalisation followed strictly the Washington Consensus, a large number of small shops emerged in both urban and rural areas. This study analyses the reasons for this boom in retail start-ups as well as the constraints the mainly inexperienced merchants encounter. As will be shown, any success in retail activities depends greatly on the performance of other economic sectors. The main goal of starting a retail business is to minimize risks within the overall livelihood strategies of households in rural Kyrgyzstan.     

Die Konstruktion der soziologischen Realität durch Forschungsrating

The article subjects the research rating of sociology, published in 2008 and carried out by an evaluation group on behalf of the German Science Council, to a secondary analysis. It is shown that the research rating constructs a reality of sociology which does justice neither to the variety of sociological knowledge production nor to its own claim of multidimensionality. Unwillingly, the peer reviewed article has imposed itself as the dominant criterion for assessing the research quality of research units against other types of publication and other activities such as externally funded research, knowledge transfer for practical problem-solving and knowledge diffusion in the public sphere. This preference also affected the assessment of entire research institutions with regard to their impact and efficiency as well as the devaluation of knowledge transfer and diffusion. In this way, sociology is limited to the type of professional sociology, while critical, public and policy-oriented sociology are displaced.     

Der zivilrechtliche Schutz der Fischereiausübung – sonstiges Recht ohne Wert?

Zusammenfassung  Erst jüngst hat der für Fischerei- und Jagdrecht zust?ndige Dritte Senat des Bundesgerichtshofs seine st?ndige Rechtsprechung zum zivilrechtlichen Schutz des Fischereirechts best?tigt. Demnach wird dem Fischereirecht zwar grunds?tzlich die Stellung eines sonstigen Rechts im Sinne von § 823 Abs. 1 BGB einger?umt. Eine Schadensersatz ausl?sende Verletzung des geschützten Rechtsguts liege aber nur dann vor, wenn auch der Kernbereich des Fischereirechts zielgerichtet berührt ist. Nach der Definition des Bundesgerichtshofs liegt dieser Kernbereich allein im “Fang und der Aneignung der Fische”, so dass es nach dieser Sichtweise nur in jenen F?llen zu einem Schadensersatz oder zur Haftung eines St?rers kommen wird, in denen der gesamte oder Teile des Fischbestands vernichtet werden oder der Fischfang g?nzlich unm?glich gemacht wird. Diese Sichtweise wird weder der Bedeutung des Fischereirechts für die Allgemeinheit, noch den berechtigten Interessen der Rechtsinhaber gerecht. Stattdessen ist eine differenzierte Sichtweise, die nach der Intensit?t der Beeintr?chtigung unterscheidet, angebracht. Hierbei muss auch der Fischereiausübung über Fang und Aneignung hinaus die Stellung eines schützenswerten Rechts einger?umt werden, um einen effizienten zivilrechtlichen Schutz zu gew?hrleisten.
